Trademark Use Policy

1 Trademark Policy

The use of any trademark, logo, or other proprietary information (including images, text, page layout, or form) of OXID eSales AG and its affiliates without express written consent is prohibited. In particular it is prohibited to register an Internet domain name that includes "OXID", “OXID eSales” or any of the OXID eSales AG trademarks or any trademarks that are confusingly similar to the OXID eSales AG trademarks. In addition it is not allowed to use any URL, meta tags or any other "hidden text" utilising OXID eSales’ or its affiliates' names or trademarks.

2 OXID eSales “Conditional Use” Logo

You are granted a limited, revocable, and non-exclusive right to use the “conditional use” logo if you wish to show your support for OXID eSales AG and its products and services by displaying this logo in the user interface of a website. The "Conditional Use" Logo may be used without specific written permission from OXID eSales AG if and to the extent the following conditions are fully met:
The "Conditional Use" Logo must be a "clickable" link that leads directly to http://www.oxid-esales.com/.
If the website has password-protected areas, the "Conditional Use" Logo must be placed only in areas that are not password-protected
The limited license given herein does not include the right to use the "Conditional Use" Logo or any other OXID eSales Logo as a trademark to promote your own products or services. For example, no OXID eSales Logo may be used on any product packaging or documentation, such as (without limitation) on CD-ROM or diskette labels or packaging, books or other publications. Any such use must be expressly authorized by OXID eSales in a signed, written agreement;

The OXID eSales "Conditional Use" Logo:

OXID eSales AG reserves the right to revoke this authorization at any time in its sole discretion. For example, if OXID eSales AG believes that your use of the OXID eSales AG "Conditional Use" Logo is detrimental to any of the OXID eSales AG trademarks or is otherwise unacceptable, OXID eSales AG will revoke this authorization. Upon revocation of this authorization by OXID eSales AG, you shall immediately cease using the OXID eSales AG "Conditional Use" Logo. If you do not immediately cease using the OXID eSales AG "Conditional Use" Logo upon revocation by OXID eSales AG, OXID eSales AG may take whatever action it deems necessary to protect its rights and interests. Although as a general rule you must never modify the design, add or delete any words, or change any colours when using the OXID eSales AG "Conditional Use" Logo, you may adjust the overall size of the logo, so long as adjustments are made proportionally.

3 Warranty; Liability; Indemnity

Use of the OXID eSales AG “conditional use” Logo is at your own risk. The use permitted under this licence is without any warranties whatsoever; including (without limitation) any warranty of non-infringement. You agree to indemnify and defend OXID eSales AG and hold OXID eSales AG harmless of and from, any claim, action, suit, loss, cost, expenses, ot other damages or liability whatsoever arising out of or resulting from your use of the OXID eSales AG “Conditional use” Logo.
You agree that you will not acquire rights in any OXID eSales AG trademark through your use of the OXID eSales AG "Conditional Use" Logo. By using OXID eSales AG "Conditional Use" Logo, you agree to the terms contained in this Trademark Use Policy.
